Anna Nicole Smith's daughter will inherit the former Playboy model's estate, a judge has ruled.

Eighteen-month-old Dannielynn Hope was named sole heir by Superior Court Judge Mitchell Beckloff, who also set up a trust in the girl's name.

Her father, Larry Birkhead, and Smith's executor, Harry K. Stern, will be co-trustees.

Beckloff granted a petition filed by Stern, who wanted to clarify Smith's intentions toward her daughter. Smith drafted a will in 2001 - five years before the child was born - that left her estate to her then-only son, Daniel. However, it said the assets in Daniel's trust should be shared equally if she had future children.

Daniel was 20 when he died in 2006, three days after Dannielynn was born.

"We and Mr. Stern always believed that Anna Nicole never intended to disinherit her daughter," Stern's lawyer, Bruce S. Ross, said after the hearing. "I'm pleased to say this chapter in the saga is closed."

Dannielynn could inherit millions of dollars if the estate wins an ongoing court fight over a will by Smith's wealthy second husband, J. Howard Marshall, that left much of his fortune to the model. His relatives have been fighting the will for years.

The dangerous amount of methadone taken by Anna Nicole Smith’s 20-year-old son was the main factor behind his death, the Bahamian police’s forensics chief has told an inquest into his death.

Superintendent Quinn McCartney’s conclusion differs slightly from the findings of two pathologists who said Daniel Smith was killed by an interaction of methadone and two antidepressants.

"Even if there were no other drugs present in (Smith’s) bloodstream, the methadone level would be enough to set off alarms," said McCartney, who added that the young man had bloody froth in his lungs that he interpreted as a "clear sign of overdose".

Daniel Smith collapsed and died on September 10, 2006, as he visited his celebrity mother at a Nassau hospital where she had given birth three days earlier.

Police believe he came to the Bahamas the night before and went directly to the hospital where he spent the night with his mother, her boyfriend, Howard Stern, and his newborn half-sister.

McCartney said the methadone could have been in his system when he arrived.

Anna Nicole Smith, a reality TV star and former Playboy playmate, died on February 8 in Florida from an overdose of prescription drugs, including a sleep aid that she reportedly took to cope with grief over her son’s death.

A lawyer for Mr Stern said that Daniel was taking medications including methadone, which is often prescribed as a pain reliever or to suppress drug withdrawal symptoms, to treat either depression or back pain.

Howard Stern, the companion of US model Anna Nicole Smith and executor of her will, has filed court papers seeking six per cent of whatever her estate might recover from her late husband’s fortune.

Stern filed his creditor’s claim on Thursday in Los Angeles Superior Court, citing a contingent fee agreement on file in bankruptcy court.

Anna Nicole, who died in February in Florida, was the widow of Texas oil tycoon J Howard Marshall II.

She had been fighting Marshall’s family for years over his estimated 500 million dollar (£246 million) fortune.

Her 13-month-old daughter, Dannielynn, stands to inherit any portion of the money that might have gone to her mother.

Biography

Vickie Lynn Hogan, better known as Anna Nicole Smith, was born on November 28 1967 in Houston, Texas and raised in nearby Mexia by her mother after her father left the family.
Although she had aspirations to become ’the next Marilyn Monroe’, Vickie began working at Jim’s Krispy Fried Chicken where she met her first husband, Billy Wayne Smith. They married when Vickie was just seventeen. The next year she gave birth to their son Daniel and in 1987 seperated from her husband, finding work as an exotic dancer in Houston.

Whilst working as a stripper she met elderly millionaire J. Howard Marshall, with whom she began a relationship despite the sixty three year age gap. In 1994 the couple married amid much tabloid excitement. Marshall died thirteen months later, leaving nothing to his young wife.

In the interim Vickie, now going by the name Anna Nicole Smith, appeared on the front cover of Playboy, being made Playmate of the Year by Hugh Hefner. She bagged a deal with Guess?, replacing supermodel Claudia Schiffer and finding herself a household name. Meanwhile Anna Nicole battled Marshall’s sons in the courts for her share of her late husbands millions, however she was eventually bankrupted and ordered to pay $1million dollars in fees. She was again given the right to fight for her entitlement following the death of her stepson.

Anna Nicole’s acting career was much less publicised than her marriage, although she appeared in high profile films The Hudsucker Proxy and Naked Gun 33 1/3. Her bigger roles came in smaller films such as To The Limit and Skyscraper and on television, appearing as herself in wacky reality TV series The Anna Nicole Show. She later apeared in Be Cool and Wasabi Tuna.

On September 7 2006 Anna Nicole gave birth to a daughter, Dannielynn Hope Marshall Stern, claiming the father was her lawyer Howard K Stern, although her ex boyfriend, Larry Birkhead, claimed the child as his. Three days later her son, Daniel, died of an apparent drug overdose while visiting his mother and half sister in hospital. Later that same month Anna Nicole and Howard K Stern exchanged vows in a commitment ceremony in the Bahamas.

On February 8 2007, the day after a date for a paternity test on her daughter had been set, Anna Nicole collapsed at a hotel in Florida and later died. An autopsy has yet to determine the cause of death.
